Ye sari bate CBI ko lekar Sarkar aage lagoo karane ja rahi hai.

POST par v mil jayega. Esase pahale mai batadoo ki Pradhan Mantry Shree Manmoham Singh Jee ne 27.11.2013 ko LOKSABHA me LOKPAL par ek Bhashan diye the, jisame CBI ka v jikra hai, usaka kuch ansh mai niche likhane ja raha hoo.....

                        We believe that the CBI should function without interference through any Goverment diktat. But no institution & no individual, howsoever high he may be, should be free from accountability. All institutional structures must be consist with our constitution. Today we are given to believe that a Goverment that is directly elected by the people & accountable to it can not be trusted to wield its immense powers with honour & trust. No entity should be created inconsistent with our constitutional framework & changed with onerous executive responsibilities without any accountability. In the ultimate analysis, all institutions within the framework of the constitution are accountable to Parliament & Parliament alone. In our enthusiasm to enact this law we must not falter. I believe that the CBI  should function independently of the LOKPAL. I also believe that the CBI should function independently of the Government. But the independent does not mean absense of accountability. We have, therefore, proposed a process of appointment of the CBI DIRECTOR which involves the Prime Minister, the Chief Justice of India or his nominee & the Leader of the Opposition in the Lok Sabha. None should have doubts about the integrity of the process. As far as the issue of CBI functioning under the Lokpal is concerned, my Government believes that this would create an executive structure outside Paliament which is accountable to none. This is anathema to sound contitutional principles. I believe that the Bill which is now on the House contains a judicious blend of functional autonomy & accountability of the CBI. I am sure that the wisdom of this House will rise to support my Government's proposal as reflected in the Bill."

S.C. me case darja karane gaye the, jise Sarkar, Vipakshi Party, Media & S.C. v chhipa rahi hai. Jab pahali bat S.C. me es mamale par Hearing hue thi, usake bad rat me ek Debate me Vipaksh ke vakil Prashantbhushan Jee ne khulkar kaha tha ki CBI DIR. ko apane pad se tyagpatra de dena chahiye & Ex. Varvadi me ek A.C. ka part tootkar phaika hua tha, kuch Saphed colour ke pankhe ekatathe kholkar rakhe hua the alag-2 v nahi, kuch Patthar bikhare the, Reporter ke anusar MALABA Phaila tha; lekin vo Malava Kichada nahi tha, ab aap sochiye ki etani jaldi Badh ka malava such kaise gaya. Aur Nitin Jee & Adavani Jee Sangh Pramukh se mulakat kar meri bato par muhar laga diye vo meri bato se Aanjan nahi hote, ye v ek sabot hai; kyoki estipha dene ke bad Adavani Jee Media se bat karane nahi aaye, achanak se Sangh-Pramukh key aha kyo ja rahe hai? Aur jahatak MARATHO ki bat hai to MAHARASHTRA me etana bada Akal pada, Ghotale hua aapki PARTY ne kya Stand liya, ‘AAVAJ’ to Bihar se maine uthayi. Jahatak BALA SAHAB THAKARE JEE ka saval hai to kisi ne unake NIDHAN par Unhe ‘GADDAR’ kaha tha to kisi ne kaha tha ki “Kisi ki lokpriyata ka andaja usake nidhan ke bad hota hai”. CONTITUTION  & RULES
Article 1 Object
The object of United Democratic Party is the well-being & advancement of the People of India & the establishment in India, by peaceful & constitutional means, of a Socialist State based on Parliamentary Democracy in which there is equality of opportunity & of Political, Economic & Social rights & which aims at world peace & fellowship.
Article 2 Allegiance to constitution of India
United Democratic Party bears true faith &allegiance to the Contitution of India as by Law established & to the priniples of Socialism, Secularism & Democracy & world uphold the sovereighty, unity & integrity of India.
Article 3 Contituents
United Democratic Party will include the plenary & special sessions of the Party &
(a) National Committee
(b) Working Committee
(c) Pradesh Committee
(d) District Committee                                                                                             
(e) City Committee
(f) Block Committee
(g) Panchayat/ Wards Committee
NOTE :In this Contitution wherever the word “Pradesh” its means also occurs “Territorial”.

Rule Under Article 3 (D)-Contituents- City Committee
The Pradesh Committee with previous approval of the working committee will have the right to constitute City Committee in the cities with population of over 5 Lakh. The city committee thus formed will have the Status of a District Committee.

Article 4 Territorial Division

(C) Pradesh Committee may, with the previous sanction of the working committee, change its headquarters.
(D)                        The Working Committee may, after ascertaining the wishes of Pradesh Committee or Committee concerned, constitute a new Pradesh, abolish Pradesh has into one or assign to a Pradesh, a District or a portion of a District From any other Pradesh.
(E)  Working Committee shall have the power to give representation in such manner as it thinks proper to areas in the Union of India as have not been included in the jurisdiction of any Pradesh Committee &/or direct that such an area or part thereof be included in a neighbouring Pradesh.

Article 5 Membership
(A)
1. (a) Any Person of the age of 18 or over, who accepts Article 1, shall, on making a written declaration in membership from & on payment of Rs. 5.00 only as subscription for five years become a Member of Party Provides that he/she is not a member of any other PoliticalParty, Communal or other, which has a separate membership, constitution &programme.
(b) No person shall be eligible to become a member except at his permanent place of residence or at a place where he carries on his business or work.
(c) The term of membership, shall be from 1st of January of the year or from the date of enrolment of member upto 31st December of the following fifth year.
(d) Permanent Register of members within their jurisdiction shall be maintained by every Block/Contituency& city/town Committee with copies to the District Committee, as per prescribed rules.
(e) Renewal of membership will be deemed to have been completed by depositing requisite membership free.

2. (a) Aperson who has been a member for at least three years shall only be eligible to be elected as a delegate or an office bearer of any Committee.
(b) Any member who wants to become a delegate or an office bearer of any Committee shall deposit an amount of Rs. 100/-
(c) The five yearly subscription paid & deposits made under the foregoing provisions of this clause by members shall be distributed in the following proportions between the various Committee:
     National Committee                           10%
     Pradesh Committee                             25%
     District Committee                               25%
      Subordinate Committee                      40%
NOTE: 40% share of membership subscriptions &deposites to be proportionately distributed amongst various Subordinate Committee below the District Committee shall be determined by Pradesh Committee concerned.

(B) Every Member will have to fulfil the following Conditions & make a declaration in Membership Form under his/her signature:
(a) He/She is the age of 18 & over.
(b) He/She neither believes in nor practices untouchability in any shape or form & undertakes to work for its removal.
(c) He/She believes in an integrated society without distinction of religion or caste.
(d) He/She abstains from alcoholic drinks & intoxicant drugs.
(e) He/She undertakes to perform minimum tasks including manual labour as may be prescribed by working committee.
(f) He/She does not own any property in excess of the ceiling laws applicable to him/her.
(g) He/She subscribes to & works for promoting the principles of Secularism, Socialism & democracy; does not directly or indirectly, openly or otherwise adversely criticize the accepted policies &programmes of the Party, except through Party forums.
(h) He/She shall subscribe to the periodicals approued by National Committee.
(C) TRAINING FOR MEMBERS
(1)Every Member shall undergo a minimum training as may be prescribed by Working Committee.
(2) No Member shall be entitled to contest for the election to:
                                                   i.            National Committee
                                                ii.            Pradesh Committee
                                              iii.            District  Committee
                                              iv.            City Committee
                                                v.            Parliament, the state Legislature, Metropolitan councils or Local Bodies contested on Party ticket.
                            Unless he undertakes to undergo a minimum training as may be Prescribed by Working Committee.
(3) No person shall be selected for election on Party ticket to Parliament, State Legislature & Local Bodies unless he is a Party Member.

(D)RENEWAL OF MEMBERSHIP
Membership may be renewal by filling up the membership Form.
       I.                        Pradesh Committee shall print Membership forms. But Pradesh Committee Executive may authorise District Committees in writing to print membership forms. Any District Committee, printing the membership forms without such authorization, shall be Liable to disciplinary action.
     II.                        Membership forms shall be serially numbered & in the case of those printed by District Committees, they should bearn the name of the District concerned as well. Full details of Forms so printed shall be supplied by District Committees to Pradesh Committees before they are issued to subordinate Committees.
  III.                        All membership forms should be bound in books of 25 forms each.
 IV.                        (a) District Committee shall be primarily responsible for the enrolment of members in the District. Pradesh Committee shall issue membership forms to the District Committees which in turn shall issue them to the subordinate Committees & through them to individuales. Not more than 1250 membership forms shall be supplied to an individual at a time. However, in the case of MPs, MLAs, MLCs & National Committee Members & Pradesh Committee office-bearers, 2500 membership forms may be supplied to such individuals only when full account of the forms already supplied is rendered & the fees realized thereof are paid.
(b) If there are complaints against the subordinate Committees that are not making available enough membership forms, District Committee may issue them to individuals & may, if it deems fit, take disciplinary action against the Committees concerned. If there are complaints that District Committees are not issuing forms properly Pradesh Committee shall directly & may also take disciplinary action against District Committee’s concerned.
(c) Forms for enrolment of members shall in no Case be issued to individuals who are not members of the Party.

    V.                        (a) When membership forms are issued to individuals or Committees, a signed acknowledgement shall be obtained in all cases & an undertaking to return the unused forms with proper accounts, whenever called upon to do so, should be obtained.
(b) When unused membership forms are returned by individuals or Committees a signed acknowledgement shall be issued. In the event of any individual failing to return the unused forms &/or accounts in time he shall be disqualified from contesting the organizational elections.
VI.       (a) Pradesh  Committee shall maintain resiste for the issue of membership forms showing the number of forms issued to each Committee or individual with their serial numbers & dates of issue & return of unused forms.
           (b)  District Committees & the subordinate Committees should also maintain similar registers.
            (c) In order to give the Party a well informed& ideologically oriented cadre, the Partymen at all levels shall participate in the study programme laid down by Working Committee for members.
VII.     (a) No person shall be enrolled as a member by any Committee or individual unless he pays the full subacription& also fulfills the conditions laid down in Article V (b) of the constitution.
VIII.    (a) Pradesh Committees shall send to National Committee report of members enrolled during the year giving details of Membership figures within two months of the last date of enrolment for the corresponding year. Along with this report, Pradesh Committee shall also send the full quota of membership fees & Party Fund due to National Committee as well as a list of Memberers with full particulars.
          (b) Any Pradesh Committee or its subordinate Committee which fails to comply with these rules shall be liable to disciplinary action.
IX. Membership forms printed or issused for one District shall in no ease be used in another District without obtaining the prior approval of
thePradesh Committee concerned.
X. Area of enrolment of Members shall be confired to Pradesh concerned.

Rule Under Article 5 (A) (a) (v)-Renewal of Membership
Renewal of Membership of a person will be deemed to have been completed by depositing triennial subscription of Rs. 5/- as membership fee. The deposit of fee shall be entered in the permanent register in the name of each member. The purpose against the name of each member. The member is depositing the fee shall be given a separate receipt of payment. Such receipt books shall be printed & supplied by Pradesh Committee.

Rule Under Article 5(B)-Membership:
1.    The following shall be the minimum tasks for members Under Article 5(B) (f) of the constitution:
(i)Enrolment of Members
(ii)Collection of Party Fund
(iii)Minimum one week’s manual labour every year which may      include Padyatras, Constrution of approach roads, digging of Slums, Village Sanitation, Works for Empowerment of Panchayats&Municiple Corporations, Empowerment of Women, Works for Removal of so many Social Problem through “JAN-JAGARUKATA ABHIYAN” as Street Play & so & so, Works against Dowary system, Modernization in Sociaty with concern of our Calcute& Civilization, Works against “BHRASHTACHAR”, Social, Economical & Political increasement of the SC/ST/OBC/Minority, Create a envornament of Studies, Arts, Sports, employment &Bussiness, “KRISHI-BAJAT” & “KRISHI-SURVE” for FARMERS in the Annual BAJAT, Skill Devolapament Planning for the Youth (Men & Women), “KUTIR UDYOGA” in Villages & Towns through NGOs, Works against Child Labour, Judicial Reform (in the sence of speed trail),  A Plan for ‘Terrorist’ & ‘Naxale’ to connect the main Exetrem of the Sociaty, A Slogan of “ATITHIDEVOBHAVAH” & “SARVAJAN HEETAY, SARVAJAN SUKHAY”, A transparent FOREIGN POLICY with the GLOBAL WORLD & Brotherhood relation with the Naighbours in the field of Political, Economical, Calcutural&Strategical issuesetc…..
Note:-The People, The Party Member & The Party Leader are not allowed to misbeheviour of Respected Administeter, Officer or The Govt. Worker to without any strong reasons.
(iv) TrainingProgrammes of Political & ideological study as directed by Working Committeefrom time to time shall be applicable to Members, Office bearers of the organizational Committees & Party Legislators. Failure to participate in the programmes so laid down may attract disqualification for holding office in the organization.
(v) Enrolment of subscriber to Party periodicals published by any Party Committee or any periodical recognized by any Pradesh Committee concerned.
(vi) Members shall promote one or more of the following constructive acitivities:
(a) Education
(b)   Prohibition
(c)  Organisation of Youth, Student & Women
(d) Organisation of Labour
(e) Organisation of Farmers
(f)   Organisation of Bussinessmen
(g)    Small saving Campaign
(h) Rashtrabhasha Committee
(i)       Promotion of Co-Operatives
(j)       Work in the Constituencies
(k) Humlog (as Social Committee)
(l)       Leprosy work
(m)                        Welfare of SC & ST
(n)    Removal of Untouchability
(o)     Work for National Integration-work Specially among       Minorities
(p)   Adult Education & Library Movement
(q) Comminity Holes in Every Village
(r)     Sale of Party Literature
(s)    Any special Programme as may be laid down by Working Committee from time to time

Rule Under Article 5(B)(i)-Subscription to Party Periodical for Membership:
                                        Every Member shall pay as subscription to the periodical approval by the National Committee i.e. “HAMARA PATRA”. The subscription amount shall have to be deposited along with his/her enrolment/renewal form. However, such of those persons who desire become Members but can not afford to pay subscription for “HAMARA PATRA” along with his/her enrolment fee are permitted to pay the same within one year after their enrolment as Members. Howevers, for the Members who get elected to any of Committee, it shall be mandatory to enrol themselves as subscribers of the Party Periodical i.e. “HAMARA PATRA”. In the case of elected representatives like MPs, MLAs, MLCs, Panchayat Raj Members & all Party functionaries at Block level & above subscribing to “HAMARA PATRA” is compulsory.
                                               In cases where there are more than one Member in a Family they will be granted exemption from subscribing to the “HAMARA PATRA” by each of the members in a family shall subscribe to the “HAMARA PATRA”. In such cases Block Committee/District Committee President is authorized to grant exemption for the rest of the members from paying this subscription.
Article 6 Term of Party Committee:
(a)The term of every Party Committee & of its office bearers, Executive Committee & members shall ordinarily be five years.
(b)The meeting of District Committees, their Executive Committees & Pradesh Committees & their Excutive Committees shall ordinarily be held regularly within the stipulated time frame as prescribed in rules.
(c)No office Bearer of the Party shall hold an office ordinarily for more than two consecutive terms at Block/District/Pradesh Committee levels.

Article 6(A) Reservation for Women/SC/ST/OBC/Minorities:
(a)33% of the seats at different Committees shall be reserved for the women.
(b)Not less than 30% of the seats shall be reserved at different for SCs/STs/OBCs/ & Minorities.
Not with standing any thing contained in the above provision in the Article 6(A) (a), Article 6(A) (b) the National President shall have the authority to relax the percentage of Section representations for the categories stated above.

Rule Under Article 6-Term of Party Committee:
The term of Party Committee shall be co-terminus with the period of Membership which has a three year term from the Commencement of Membership & shall ordinarily function for three years or continue to function till the new Committee is elected as & when decided by Party Working Committee.

Rule Under Article 6(ii)- Meetings of Party Committee:
The General Bodies of Pradesh Committees shall meet atleast once in six months & the Excutive Committee atleast once in three months. Similarly, the General Bodies of District Committee shall meet atleast once in six months & the Executive Committees atleast once in two months or as often as may be required.

Rule Under Article 6 (A) (a) & (b)-Reservation for Women, SC/ST/OBC/Minority:
The General Bodies of Pradesh Committees shall meet atleast once in six months & the Excutive Committee atleast once in three months. Similarly, the General Bodies of District Committees shall meet atleast once in six months & the Executive Committees atleast once in two months or as often as may be required.

Rule Under Article 6 (A) (a) & (b)-Reservation for Women, SC/ST/OBC/Minority:
1.    The election ti Block Committees from Primary Units shall be held as provided in the Constitution. For the purpose of election of the Executive Committee of Block Committee there shall be reservation of not less than 33% for SC/ST/OBCs/Minority. In case of shortfall in the requisite number of the reserved categories of Members, the shortfall shall be made good by co-opting upto 15% of total membership & the members so co-opted will have full voting rights to fulfill the constitutional requirements of Article 6 (A).
2.    For the purpose of election of District Committee Members by Block Committees, 2 seats out of 6 shall be reserved for WomenMembers, 1 for SC/ST/OBCs & 1 for Minority Categories from each Block.
3.    Number of members in the Executive Committee of Block Committee shall be fixed in the constitution of the respective Pradesh Committees.
4.    Not less than 33% of the Number of the members of the Executive Committee at various levels shall be reserved for Women & not less than 30% shall be reserved for SCs/STs/OBCs/Minorities. i.e. 63% of the seats shall be reserved for the sectoralrepresentativies as provided under Article 6 (A) of the Constitution.
5.    To give sectoral representation at National Committee level under Article 6 (A), not less than 33% of number of seats to be elected to the National Committee from each State shall be reserved for Women & not less than 30% of that number shall be reserved for SCs/STs/OBCs/Minoriyies.
6.    For the election of members of the Party Working Committee under Article 19(a) of the Contitution, out of the 12 Members to be elected by National Committee, not less than 4 members shall be elected from amongst Women Condidates& not less than 2 from amongst SCs/STs/OBCs/Minorities.
7.    The Ballot-Paper for elections at all levels should be a common Ballot-Paper indicating the reserved Category of each Candidate.
8.    The Ballot-Paper to be used in the elections to various bodies covering both Reservation category Candidates & general category shall be the same.
9.    At the time of counting in the first instance under both reserved categories, the Women & SCs/STs/OBCs/Minorities together who have got the highest number of votes in the order of ranking shall be declared elected. However, if any of them Scores more than the rest of the general category candidates than such of the persons who have scored higher than such of the general category candidates shall be treated as won/elected from general category & the rest of the seats in the reserved category will be decided on the basis of highest ranking in each of reserved category separately so as to fill up the rest of the number of seats.
10.                       Wherever the word OBC occurs it should also mean Backward Class (BC).


Article 7 Resister of Members & Contribution to Party Fund:
1.  Register:
(a)             Permanent Register of Members shall be maintained by District Committees. A copy of the Permanent Register duly certified by District Committee President shall be made available to Pradesh Committee. District Committees will issue Identify Cards with photographs of the members pasted on the cards under siganatures of Pradesh Committee concerned.
(b)             Pradesh Committee shall supply a duty certified copy of the Permanent Register of Members within their jurisdiction to the office to National Committee & keep it informed of any changes made therein from time to time.
(c)              The Register shall contain the full name, address, age, occupation, place of residence & date of enrolment of every member.
(d)             Membership shall cease by death, resignation, removal or non-payment of contribution & non-renewal of membership.
2.    Contribution to Party Fund by Members:
Each Member shall have to contribute to the Party Fund certain percentage of his income, as prescribed in the rules by the Working Committee.

Rule Under Article 7 (1) (a) & (c): Register of Members & Identity Cards:
1.              Register:-
The permanent register of Members which will be maintained by Pradesh Committee, shall contain the following particulars about each Member:
(a)             Serial Number
(b)             Name
(c)              Male/Female
(d)             SC/ST/OBC/Minority
(e)             Father’s or Husband’s Name
(f)               Address
(g)             Age
(h)             Occupation
(i)                Place of residence
(j)                Form No…………..Of Membership
(k)             Name of Subordinate Committee of which the applicant is member
(l)                Date of Renewal of membership
(m)          Term of Membership
(n)             Remarks
The Pradesh Committee will, however, on its own initiative or on appeal, scrutinize (delete or add) the Permanent Register of Members maintained by District Committee.
2.              Identity Cards:
                               District Committee will issue Identity Cards to each Member with his photograph pasted on it. The card will bear signature of the President of District Committee & Pradesh Committee concerned.For this purpose each Member shall submit a copy his/her photograph of passport Size to District Committee office.
3.              Alterations in Registers:
                Alteration in the lists of Members & registers of Members, if any, necessitated by the decision of the Executive of District Committee or Pradesh Committee as a result of disciplinary action taken, shall be recorded in red ink under the siganature of the President or the Secretary of the Committee Concerned.


Rule Under Article 7 (2): Contribution to Party Fund by Members:
1.    Each Member shall contribute to the Party Fund as Follows:
(a)   Re.1.00 per month for net monthly income uptoRs. 300/-
(b) 2% of net monthly income above Rs. 300/-
2.     The total amount of contribution, as categorized above will include the membership subscription amount which, according to the provision of the Constitution each Member is required to deposit triennially along with his/her Membership Form. The concerned Member shall send the balance of the contribution, to Pradesh Committee office annually at regular intervals (not more than 12 instalments a year).
3.    Each Member shall send to Pradesh Committee office a statement declaring his/her net monthly income (after deducting income tax) & the number of instalments to be paid by him/her towards the Party Fund.
4.    Pradesh Committee office shall send to each Member a receipt of the contribution paid by him/her.
5.    The contributions received from the Members, under the provisions of Article 7(2), will be distributed as under:
Reserved the Central Election Fund:   50%
National Committee                           :    25%
Pradesh Committee                             :    12.5%
District   Committee                             :    12.5%
6.    Pradesh Committee shall immediately send to National Committee its share of the contribution i.e; 50% for the Central Election Fund & 25% for National Committee. Pradesh Committee shall also send the share of the District Committees to the respective districts.
7.    The Subordinate Committees below District Committee may be paid share of the Contributions as may be determined by the Pradesh Committee Concerned from out the share District Committee.


Article 8 Primary Comittees& Qualification of Voters &Condidates:
(a)      Primary Committees:
                       The members of a basic unit will elect its President & an Executive Committee. The President & an Executive Committee. The President shall fulfil the eligibility conditions specified in Article 5 (A) (b). The President shall appoint a Secretary from amongst the member of the Executive Committee.
(b)     Voters:
Every Member whose name is recorded in the Permanent Register maintained under Article 5 (A) (a) shall be entitled to vote in election of members of the Subordinate Committee.
(c)Candidates:
                    Only a member who fulfills the eligibility conditions of Article 5 (A) (b) shall be eligible for election as a member of any Committee other than a Primary Committee.


Rule Under Article 8 (a)-Primary Committee:
1.      A Primary Committee will be the basic unit of the organization.
2.      A Primary Committee shall, as far as possible, correspond to the area of territory falling under one Polling Both or Polling Station in the General Elections.
3.     All Members of the Primary Committee shall meet at an appointed time & place & elect the President, Vice-President & a Treasurer & the Executive Committee of the Primary Committee.
4.     The President of the Primary Committee & the delegates to Block Committee shall be elected from amongst the Member can eligible under Article 5 (A) (b). Any Member can seek election to the Membership of the Executive Committee. The President shall appoint the General Secretery from amongst the Members of the Executive Committee.
5.     The Election of the President, Vice-President, Treasurer &Excutive Members of the Primary Committee shall be by show of hands.


Rule Under Article 8 (b) & 7 (1) (a)-Preparation of Roll of Members:
1.     District Committee shall before the 31st of March in Every three years or at such time as the Party Working Committee may decide, Publish the Preliminany roll of Members enrolled or renewed during the Previous term. The revised & final roll, after Scrutiny under Rules 1 & 2 of Article 22 of the Constitution, shall be published not later than the 31st of May every third year or at such time as the Working Committee may decide.
2.    The final roll published as above shall be in force till the next roll is prepared.


Article 9 Subordinate Committee:
(A)            Pradesh Committee shall constitute a Subordinate Committee for a Panchayat Development, Block or PanchayatSamiti or Panchayat Union, as the case may be, & it shall be known by name “Block Committee”.

Provided that in any urban or otherwise special area, a Sub-ordinate Committee may be constituted for such territory as may be determine by Pradesh Committee with the Previous approval of the Working Committee & such Committee shall also be known by the name “Block Committee”.
(b)Pradesh Committee may constitute any other Committee such as village Committee, Area Committee or Neighbourhood Committee which may consist of two or more Primary Committees & shall be subordinate to the Block Committee.
(c)Every Primary Committee shall be subordinate to the Block Committee for the Area.
(d)  Every Primary Committee shall elect a delegate to the Block Committee. A Member, who is enrolled in the basic unit shall be a Candidate, if he fulfills the eligibility conditions of Article 5 (A) (b). Such delegate shall be member of Block Committee.
(e)  Block Committee shall consist of the Presidents of the Primary Committee. Area Committee or Neighborhood Committee, the President of such Committees shall be co-opted as members of Block Committee but they shall not have the right to vote in any election of officebearers of Block Committee or of delegates to District Committee &Pradesh Committee.
Rule Under Article 9- Subordinate Committee:
1.         Pradesh Committee shall constitute a Subordinate Committee for each Panchayat Development Block or PanchayatSamiti or Panchayat Union as the case may be.
2.         In any Urban or otherwise special area Pradesh Committee shall constitute a Subordinate Committee for such territory or area as may be determined by Pradesh Committee with the previous approval of the Working Committee.
3.         The Subordinate Committee so constituted shall be known by the name Block Committee.
4.          Every Primary Committee Subordinate to Block Committee shall be entitled to elect one Member to Block Committee provided, however, that there shall be atteast 25 Members in the Primary Committee. The election shall be by show of hands & declaration of results shall be by a simple majority.
5.          A Subordinate Committee will be deemed to have been constituted provided at least 50% of its Primary Committees have duly enrolled the requisite number of Members.
6.           The Working Committee shall have the authority to retax the conditions Prescribed in any of the Rules above in any special circumstrances.


Rule Under Article 9 (b)-Intermediate CVommittee:
                                   The representatives elected at the Primary Committee, i.e; the President of the Booth Committee & delegate to Block covering all the booths of the Intermidiate. Committee comprising of a Panchayat or MandalPanchayat area or a division within a Municipality shall be the jurisdiction of an Intermediate Committee. The General Body of an Intermediate Committee shall be the same as representing the unit Committee at Block Committee, i.e; the unit President as well the delegate elected to represent the Booth at the Block. Thus the General body constituted shall, from amongst themselves, elect a President, a Vice-President & a Treasurer. The President shall appoint a General Secretary. The total strength of the Committee shall not exceed eleven including all the officebearers.


Article 10 District Committee:
A District Committee shall cover an area prescribed by Prtadesh Committee in its Contitution& shall consist of:
(a)    6 members elected by secret Ballot-Paper by each Block Committee to District Committee as par rules prescribed by the Working Committee.
(b) All Ex-Presidents of District Committee who have completed a full term of 365 days & have continued to be members.
(c)        Members of Pradesh Committee, who reside in or have been elected from District.
(d) Presidents of Block Committee, provided that they shall not be eligible to become either President or Secretery of District Committee.
(e)       Members of the Legislature Parties, both Central & State, from the District, provided that they are members.
(f)         Leaders of the Parties in Municipal Corporations, Municipalities & District Borads/ZilaParishads or Janpads in the District, provided that they are members.
(g)      Members co-opted by District Committee Executive as per rules prescribed by the Working Committee.


Rule Under Article 10- District Committee:
1.(a)    A candidate for election to a Distict Committee need not necessarily be a member of a subordinate Committee. Only a Member shall be extitte to be a candidate.
   (b)     A candidate for election to a District Committee should ordinarily be resident for District concerned.
(c)      Voting in the election of Members of a District Committee by the unit members of the subordinate Committee shall be by Ballot.
2.    Special categories of persons, not adequately represent mentioned in Sub-clause (g) of Article 10, shall be co-opted by the Executive of District Committee from:
                         (i)   Women
                         (ii)   SCs/STs
                         (iii)   Minorities
(iv)    Trade Unions
                         (v)     Youth Beings
(vi)    Students Being
                         (vii)   Humlog
                         (viii)  Persons having special Knowledge or practical
                                 Experience in respect of Literature, Science, arts,
                                 Social Services etc. in the proportion of 15% of the
                                 Members of a District Committee coming under of co
                                 -option of Youth Party Workers, no person who is
                              More than 30 years shall be eligible for such co-option.
Article 9 Pradesh Committee:
1.    A Pradesh Committee shall consist of:
   (i)  Members elected by Block Committees
       (a)  Every Block Committee shall elect by secret Bllot, a
            Delegate to Pradesh Committee & such delegate shall
be a member of the Pradesh Committee.
(b) A Member ordinarily resident or having his place of business, occupation or profession withen the area of Pradesh Committee would be eligible to be a candidate for election as delegate from any Block Committee within the area of the said Pradesh Committee, Provided that:
(i)Condidates& conduct of elections will be in accordance with the rules prescribed by the Working Committee.
(ii)In the following Pradesh & Union Territories the Number of elected members of the Pradesh/Union Territory Committee shall be equal to the number of Members of the Provincial/Territorial Legislature Assembly:
1.    Goa
2.    Sikkim
3.    Arunachal Pradesh
4.    Nagaland
5.    Manipur
6.    Meghalaya
7.    Tripura
8.    Mizoram
9.    Puducherry
                            (iii) From the Territorial Committee of Chandigarh, Dada
                                -r-Nagar-Haveli, Daman & Diu, Lakshadweep &Anda
                               -man Nicobar Island Territories there shall be 25 mem-
bers each.
(ii)  Ex-President of Pradesh Committee, who have completed a full term of 365 days & have continued to be members.
                    (iii)  Presidents of District Committees provided that they shall not be eligible to become either President or Secretary of Pradesh Committee.
                     (iv)   Members elected by United Democratic Legislature Party at the rate of 5% of the number of Pradesh Committee or Territories Committee members subject to a maximum of 15.
                   (v)   Members co-opted by the Pradesh Committee Excutive from special elements not adequately represented & others in accordance with the rules prescribed by the Working Committee.
2.      Every member of Pradesh Committee shall pay an annual fee of Rs. 50.00/- to Pradesh Committee of which Rs. 25.00/- shall be remitted to National Committee as delegate fee & shall collect Rs. 100.00/- for Party Fund triennially within 3 months of his election to Pradesh Committee & deposit it election to Pradesh Committee & obtain a receipt there of. He shall receive a certificate duty signed by a Secretary of Pradesh Committee that he is a member & has collected Party Fund.
Any Member, who fails to pay his subscription or collect the Fund within the period stipulated, shall forfeit his right to exercise the functions of member, including the right to attend any meeting of Pradesh Committee, till such dues are cleared. Pradesh Committee shall formed to National Committee office a certified list of Members not later than the date fixed by the Working Committee in that behalf.
Note:- The Pradesh Committee will decide the proportion in which the Party Fund may be distributed among Subordinate Committees.
3.Every Pradesh Committee shall coordinate the activities of the frontal organisations& shall:
         (i)  Ordinarily function through District Committee.
         (ii)  Submit to the Working Committee an annual report of the Work done by the Party Organisation in the Pradesh including audited balance sheets.
        (iii)  Pay to National Committee the share due to it out of the member’s feesvide Article 5 (A) (c) & the Working Committee.
       (iv)   Pradesh, which has not completed the formation of Pradesh Committee on or before the date fixed by the Working Committee may, at the discretion of the Working Committee be disentitled to be represented at the Party Session.
     (v)    On the failure of any Pradersh Committee to function in terms of the Constitution or in accordance with the direction of the  Working Committee may suspend the existing Pradesh Committee & form an ad-hoc Committee to carry on Party work in the Pradesh.
(vi)    Each Pradesh Committee/Regional Committee shall, in accordance with the directions/guidelines issed by the Working Committee of National Committee, Constitute a trust for holding immovable properties belonging to such Pradesh Committee/Regional Committee & also the properties belonging to the Party Committees namely District Committee, Block Committee & Other Committees Subordinate to a Pradesh Committee/ Regional Committee. The Board of Trustees of the said trust shall not be be less than 3 trustees nor more than other ex-officio Trustees. The Board of Trustees shall be appointed by Pradesh Committee/ Regional Committee & shall Comprise of persons as approved by the Working Committee shall be the Chairman ex-officio of the Trust. The Treasurer of the National Committee & General Secretary of National Committee Incharged of the concerned Pradesh Committee/Regional Committee shall be ex-offio members of the Board. The term of the Board of Trustees other than the Chairman & the 2 ex-offico Trustees shall be held in the name of the said Trust & if that be not possible in a certain case, then in such manner as director by the Working Committee of National Committee.


Rule Under 11 (A)- Pradesh Committee:
1.    Election of members to Pradesh Committee under sub-clause(a) of Article 11 (A) shall be as follow:
(a)      All members of the Block Committee, which forms the Delegate Constituency, shall meet at an appointed time & place for the election & each member shall be entitled to Vote for one of the candidates. The election result shall be declared by simple majority.
(b) The voting, if necessary, shall be by secret Ballot.
(c)           A candidate for election to Pradesh Committee need not necessarily be a member of sub-ordinate Committee.
(d) A delegate constituency shall be entitled to elect its delegate Provided that Block Committee members have been duly elected in atleast50% of its basic units.
2.    The special categories of persons not adequatety represent mentioned in sub-clause (f) of clause (A) of Article 11 shall be co-opted by the Executive of the Pradesh Committee from :
(i)Women
(ii)Schedualed Castes & Scheduled Tribes
(iii)Minorities
(iv)Trade Unions
(v)Youth Beings
(vi)Humlog
(vii)Persons having special knowledge or practical experience in Literture, Science, Arts, Social Services etc. in the proportion of 15% of the members of the Pradesh Committee coming under sub-clause (a) provided that in the case of co-option of youthworkers, no person, who is more than 30 years shall be eligible for such co-option.
3.    Election of members of to a Pradesh Committee under sub-clause (e) of Article 11(A) shall be as follows:
                             The Legislative Party shall elect to Pradesh Committee 5% of the total number of Pradesh Committee or Territorial Committee members subject to the maximum of 15 by sustem of single transferable vote.


Rule Under Article 11 (B)- Collection of Party Fund:
                 Every Pradesh Committee member within three months of his or her election shall pay to Pradesh Committee concerned a sum of 100/- for Party Fund & this may be collected against coupons of such denomination that the concerned Pradesh Committee.

Rule Under Article 11 (F)-Board of Trustees in Pradeshes:
                      In case any Trustee Appointed under the provision of Article 11 (F) ceases to be a member of the Party his/her seat in the Board of Trustees shall automatically fall vacant & President of the United Democratic Party shall appoint a new Trustee to fill-up the vacancy thus caused at the level of Pradesh Committee. In the case of Board of Trustees at level i.e; District, Block or Village appoint the new Trustees to fill up the vacancies the Party President.


Article 12 Delegates:
All members of Pradesh Committees shall be delegates to the Party.

Article 13 United Democratic Party:
1.    The National Committee shall consist of:
(a)             One-eightof the number of Pradesh Committee members elected by them from amongst themselves by proportional representation according to the system of single transferable vote, provided that the number is not less than five; however 4 members each shall be elected from Chandigard, Dadra-Nagar-Haveli, Daman & Diu, Lakshadweep & Andaman Nicobar Territorises Committees.
(b)             President of the Party.
(c)              Ex-Presidents of the Party, who have completed a term of 365 days & have continued to be Active members of the Party.
(d)             Presidents of Pradesh Committees, provided that they shall not be eligible to become an office-bearer of National Committee.
(e)             Leader in the Party in Parliament.
(f)               Leaders in the Party in the Legislatures, Legislative Assemblies in Union Territories & Metropolitan Councils.
(g)             15 members elected by the Party in Parliament according to the system of single tranferable vote.
(h)             Members co-opted by the Working Committee from special categories of persons not adequately represented & others in accordance with the rules prescribed by the Working Committee.
2.       (a)      The President of the Party shall be the President of the National Committee.
              (b)The National Committee shall arrange for the implementation of the Programme of the Work laid down by the Party & shall have powers to deal with matters & situations that may arise during its turm of office.
             (c)The National Committee shall have power to frame rules, not inconsistent with this constitution, for regularing all matters connected with the Party which shall be binding on all sub-ordinate Committees.
            (d)The National Committee shall meet as often as required by the Working Committee, but atleast once a year, or on a joint requisition addressed to the Working Committee, but atleast once a year, or on a joint requisition addressed to the Working Committee by not less than 20% of the total numbers of the National Committee members having full voting rights. Such requisitioniots desire a meeting of the National Committee. The requisitioned meeting shall be held within 2 months of the receipt of the requisition, provided that not more than 1 requisition can be moved in 1 year. At any requisitioned meeting, additional items of business may be brought up by the Working Committee for consideration.
          (e)   At all meetings of the National Committee other than requisitioned meetings, atleast 2 hours shall be allotted for consideration of proposition of which due notice has been given by the members of the National Committee in accordance with the rules prescribed in that behalf.
         (f)     One hundred or one-fifth of the total number whichever is less, shall form the quorum for a meeting of the National Committee.
         (g)    Every Member of the National Committee shall pay an annual
Subscription of Rs. 100/- & shall collect Rs. 200/- for Party Fund within three months of his election to the National Committee & deposit it with the National Committee & shall obtain a receipt thereof. He shall receive a certificate of his membership duly signed by one of the Secretaries of the National Committees. Any member, who fails to pay his subscription or collect the Fund within the period stipulated, shall forfeit his right to take part in any of the meetings of the National Committee,
Subjects Committee or any Party Session till such dues are cleared up.
Note:-  A member of the National Committee need not collect fund for Pradesh Committee also.


Rule Under Article 13 (A)-The National Committee:
1.    Election of members of the National Committee under Sub-clause (g) of Article 13 (A) shall be as follows:
                  The UDP in Paliament shall elect from amongst its MPs 15 members to National Committee by proportional representation according to the system of single transferable vote. In case a member so elected ceases to be a Member of Parliament, his/her membership of the National Committee under Article 13 (A) (g) will also cease.
2.          The special categories of persons not adequately represented mentioned in Sub-clause (h) of clause (A) of Article 13 shall be co-opted by the Working Committee:
   (i)Women
   (ii) SCs/STs
   (iii) Minorities
(iv) Trade Unions
   (v)  Youth Beings
(vi) Students Beings
    (vii) Humlog
    (viii) Persons having special knowledge or practical    
            Experience in Literature, Science, Arts, Social
            Services etc..in the proportion of 15% of the
            Members of the National Committee coming
            Under sub-option (a) provided that in case of co-
            Option of Youth Workers, no person, who is more
than 30 years shall be eligible for such co-option.


Rule Under Article 13 (B) Sub-Clause(d):Reception Committee for Natinal Committee Meetings:
1.        Pradesh Committee, in whose jurisdiction tne National Committee meeting is held, shall make such arrangement for holding the meeting as may be deemed necessary, &for the porpose shall from the receipt Committee which shall Work under its General guidance & which may include there in porpose who are notitsmermbers.
2.       The Reception Committee shall elect its Chairman & other office-bearers from amongst its own members.
3.        The Reception Committees shall collect Funds for the expenses of the meeting & shall make aii necessary arrangement for the Reception & accommodation of the members. It may also make necessary arrangements for the visitors.
4.        The Receipts & disbursements of the Reception Committee shall be audited by an auditor or auditors, appointed by Pradesh Committee & the stasement of account together with the audit report shall be submitted by Pradesh Committee to National Committee office, within four months after the meetings. Any surplus Funds remaining with Reception Committee shall be divided equally betwwen National Committee & Pradesh Committee.


Rule Under Article 13 (B), Sub-Clause(e): Non-Official resolution for National Committee:
                                            Members, who wish any propositions to be considered by National Committee should send such propositions in writing so as to reach National Committee office atleast 15 days prior to the date of the meeting.

Rule Under Article 13 (B), Sub-Clause (g): Collection of Funds by National Committee Members:
                                          Every National Committee members within 3 months of his or her election shall may to the National Committee a sum of Rs. 200/- for National Fund & this may be collected against coupans of such denomination that concerned Pradesh Committee may print & supply or against the receipt books that may be supplied by Pradesh Committee.


Article 14 Co-Opted Members:
                        The Working Committee & the Executive Committee at Pradesh & lower may co-opt upto 15% of the total membership of The National Committee, Pradesh Committee & other lower Committeeconcered as per rule prescribed by the Working Committee. The Co-opted members at National Committee, Pradesh Committee & lower levels shall exercise any voting right in any organizational election non shall they contest any election in the organization, however, no person who is a co-opted member shall be debarred for that reason from seeking election to full membership of any Committee in normal manner.


Article 14 –A  Ex-Officio Members:
All elected members of the local bodies (Rural & Urban), Cooperative bodies, Agricultural marketing bodies, Legislative Assembly, Legaslative Council & Parliament, who are members of the Party shall become Ex-officio members of the corresponding Committee as specified in the Rules.

Rule Under Article 14 (A)-Ex-Officio Members:
1.    (a)       The members of the Gram Panchayats, The members of the Municiple Committees & Members of the Block Panchayats shall be Ex-Officio Members of the Primary Committee.
(b)             The Members of ZilaParishads, President of the Block Panchayat, President of the Nagar Palika, President of the Block level co-operatives & Agricultural Marketing Bodies shall be Ex-Officio Members of the Block Committee.
(c)              The Presidents of the ZilaParishad, The President of the District level coorerative bodies, The President of the District level Agricultural Marketing Bodies & Mayors of the Municipal Coorporations shall be Ex-officio members of the District Committee.
(d)             All the Members of the Legislative Assembly & of the Legislative Council shall be Ex-Officio members in Block Committees, District Committees in their Assembly segment & respective Pradesh Committee.
(e)             All the members of Parliament shall be Ex-officio members of the Block Committees & District Committees falling within their Parliament Contituency, respective Pradesh Committee & National Committee.
(f)               Ex-officio members shall not exercise any voting rights in any election held in the Respective Committees but they shall be allowed to participate in decision making discussion & vote on the resolutions.


Rule 15 Subjects Committee:
A.    The Subject Committee shall consist of:
                     (i)The President of National Committee.
                     (ii)  Members of the Working Committee.
                      (iii)  Permanent Invitees & Special invitees of the Working
Committee.
(iv)  The President of the Pradesh Committee.

                             Legislative Assembly & Legislative Council, if any
(vi)   The Chiefs of all Frontal organizations of National
                               Committee & President of National Committee of
Trade Union.
                     (vii)  Office bearers of the Parliament Party.
                     (viii)  The Chairman of the North East Coordination
Committee.
B.     The Subjects Committee shall meet under the Chairmanship of the President prior to the Party Session. The Working Committee or, in case a new President has been elected before the Session & there is no Working Committee appointed by him, functioning, a Streering Committee appointed by President, shall submit to the subjects committee the programmes of work, including draft resolution for the Party Session. The draft resolutions shall be made avaible to the members of the subjects committee/National Committee atleast 2 weeks before the meeting. While the drafting the resolutions, the Working Committee or the Steering Committee shall take into consideration the resolutions recommended by Pradesh Committee & resolution given notice of by the Members of the Subjects Committee.
C.    The Subjects Committee shall processed to discuss the Programme& shall frame resolution for being moved in the open session. As far as possible, 4 hours shall be allotted for the consideration of propositions of which for the consideration of propositions of which due notice has been given by Pradesh Committee or the members of the National Committee.



Article 14 Plenary Session:
(a)             A session of the Party shall ordinarily beheld once in three years at the time & place decided upon by the Working Committee or the National Committee as the case may be.
(b)             A Party Session shall consist of the President of the Party & all other delegates.
(c)              (i)A Party Session shall consider resolutions recommended to it for adoption by the Subject Committee in the first instance.
(ii)There after the session shall take up any substanative motion not including in (i) above, but which 40 delegates have before the Commencement for the day’s sittings, requested the President in writing to allow them to place before the Party; Provided, however, that no such motion shall be allowed unless it has been previously discussed at the meeting of the subjects Committee & received the Subjects Committee & received the support of atleast a 3rd of the members then present at the Subjects Committee meeting.
(d)             The Pradesh Committee, in whose jurisdiction the Party Session is held, shall make such Arrangements for holding the Party Session as may be deemed necessary, & for the purpose shall work under its general guidance & not its members.
(e)             The Reception Committee shall elect its Chairman & other Office-bearers from amongst its own members.
(f)               The Reception Committee shall collect funds for the expenses of the Session & shall make all necessary arrangements for the reception & accommodation of delegates. It may also make necessary arrangements for the visitors.
(g)             The receipts & disbursement of the Reception Committee shall be audited by an auditor or audoters appointed by Pradesh Committee & the statement of accounts together with the audit report shall be submitted by Pradesh Committee to the Working Committee, with 6 months of the conclusion of the Party Session. Any Surplus funds remaining with the Reception Committee shall be Divided equally between the National Committee & Pradesh Committee.


Article 17 Special Session:
(a)   The Chairman of the Central Election authority will be the Ex-Officio Returning officer for the election of the President.
(b) Any 10 delegates may jointly propose the name of any delegate for election as President of the Party. Such proposals must reach the Returning Officer onor before the date fixed by the Working Committee.
(c)    All returning officer shall publish the names of all person so proposed & it shall be open to any person whose name has been so proposed to withdraw his candidature within to the Returning officer to that effect.
(d) After eliminating the names of those who have withdraw, the Returning Officer shall immediately Publish the names of the remaining candidates & circulate then to Pradesh Committee. If, after elimination, there remains only one Candidate, he shall be declared duly elected as Prtesident of the next Party Session.
(e) On a date fixed by Working Committee, which shall not ordinarily be less than 7 days after the final publication of the names of contesting Candidates, each delegate shall be entitled to record, to the election of the Parliament, his vote in the following manner; on the voting paper which shall exhibit the names of the candidates, the delegate shall, if there are only 2 candidates, record his vote for one of them. If there are more than 2 candidates, the delegates shall record atleast 2 preferences by writing the figures 1,2 etc. against the names of the candidates voted for. In such a case, he may give more than 2 preferences will be regarded as invalid. The voting paper shall be deposited in a Ballot-Box provided for the purpose.
(f)     Pradesh Committee shall immediately forward the Ballot-Box provided for the purpose.
(g)   As soon as may be after the receipt of the Ballot-Boxes, the Returning officer shall count the votes of the first preferences recorded for each Candidate. If a Candidate secures more than 50% of the votes of the 1st preferences, he shall be declared elected as President. If no Candidate secures more than 50% of 1stpreferences shall be eliminated, & the 2nd preferences shall be taken into account in counting the votes of the remaining Candidates. In this Counting the candidates, who secures the smallest number of votes shall be eliminated. By this process of eliminating the candidates, who secure the smallest number of the votes in subsequent counting after the transfer of votes according to recorded preferences, the candidate, who secures more than 50% of the votes, shall be declared elected as President.
(h) In the event of any emergency by reason of any cause such as the death or Resignation of the President elected as above, the senior most- General Secretary will discharge the routine functions of the President unit the Working Committee appoints a provisional President pending the election of a regular President by the National Committee.
(i)    The President shall preside over the session of the Party held after his election & during his term of office & he shall exercise all the Powers of the Working Committee when it is not in session.



Article 19 Working Committee:
1.     The Working Committee shall consist of the President of the Party, the Leader of the Party in Parliament & 23 other members of whom 12 members will be elected by the National Committee, as per rules prescribed by the Working Committee & the rest shall be appointed by the President. The President shall appoint a Tresurer& one or more General Secretaries from amongst the members of the Working Committee. The President will have power to appoint one or more Secretaries/Joint Secretaries from the elected members of the National Committee. The Secretaries/Joint Secretaries will discharge the duty as may be assigned to them by the President. Ordinarily members of the Working Committee will be appointed from amongst the members of the National Committee, but in special cases, delegates who are not members of the National Committeemay be appointed; provided however, that a delegates so appointed shall cease to be a member of the Working Committee if he is not elected as member of the National Committee, within 6 months of his appointment.
2.    The quorum for a meeting of the Working Committee shall be eight.
3.    The Working Committee shall be the highest executive authority of the Party & shall have the Power to carry out the policies &programmeslaid down by the Party & National Committee & shall be responsible to National Committee. It shall be the final authority in all metters regarding interpretation & application of the provisions of the constitution.
4.    The Working Committee shall place before every meeting of National Committee a report of the proceedings of the previous meeting of National Committee & also the agenda of business for the meeting & shall allot time for non-official resolutions of which due notice may have been given by the members of the National Committee in accordance with the rules prescribed in that behalf.
5.    The Working Committee may appoint one or more auditors or inspectors or other officers to examine the records, paper &organisations. It shall be incumbent on all such Committees &organisations to the auditors, inspectors or other officers & to give them access to all offices, accounts & other records.
6.    The Working Committee shall have the Power:
         (i)to frame rules for the proper Working of the orga-
nisation. Such rules shall, as eraly as possible, be
placed for the consideration of the National Commi-
ttee.
    (ii)  to issue instructions not inconsistent with the Cont-
Itution& frame rules in all matter, not otherwise
Provided for.
     (iii) to superintend, direct & control all Pradesh Comm-
ittee& Subordinate Committee as well as the Rec-
eption Committee.
      (iv)  to take such disciplinary action as it may deem fit
against a Committee other than the National Com-
mittee or an individual.
      (v)  in special case, to relax application of provision
under Article 5 (A) (a) (i), 5 (B), 8(b) & 8(c).
7.     The Working Committee shall have all accounts of the National Committee audited annually by an auditor or auditors appointed by National Committee every year.
         8.  The Working Committee shall fix the date by which the
formation of Subordinate, District, Pradesh & National     
              Committee shall be completed.
          9.The Working Committee shall constitute a Trust
for holding immoveable properties belonging to
National Committee. The Board of Trustees of the
said trust shall be appointed by the Working Com-
mittee& shall Comprise of not less than 5 nor
more than 9 trustees including the Chairman &
shall be ex-officio members of the Board. The term
of the members of the Board of trustees shall be 3
years. The propertition shall be held in the name
of the said Trust & if that be not possible in a certain
case/cases, then in such manner as directed by the
Working Committee.
10.To meet any special situation, the Working Committee shall have the power to take such action in the interest of the Party as it may damfit; provided however that if any action is taken which is beyond the power of the Working Committee as defined in this Contitution, it shall be submitted as early as possible to National Committee as difined in the constitution, it shall be submitted as early as possible to National Committee for ratification but not bear than 6 months.


Rule Under Article 19 (a): Working Committee:
                  Procedure for election of 12 members of the Working Committee:
1.Nomination:
 (a)Only a member of the National Committee with full voting rights shall be entitled to contest the election to the Working Committee.
     (b)Nomination should be proposed & seconded by members of the National Committee with full voting rights.
      (c)A member to the National Committee canpropose as many as 12 members for the membership of the Working Committee.
      (d)Nomination paper should signify the consent of the Candidate proposed.
2.  Method of Voting:
       (a)  Voting shall be by Ballot.
       (b)  A voter can record on the Ballot-Paper as may as 12 votes.
             Provided that not more than one vote shall be cast in favour of
each Candidate.
      (c)A Ballot-Paper shall be rendered invalaid if a voter records more
than 12 votes on the Ballot-Paper.
      (d)The 1st 12 Candidates, securing the highest number of votes, shall
be declared elected.
      (e)These election rules shall apply mutatis mutandis to the by elect-
ion that may be caused.
      (f)Ballot-Papers for this election shall indicate whether the Candida-
Te belongs to the reserved Category i.e; SC/ST/OBC/Minority.
      (g)The above rules framed under Article 19 (a) shall be read with the
rules framed under Article 6(A) (a) & (b) regarding reservation for
           Women, SC/ST/OBC/Minority & made applicable for the purpose
of ensuring reservation for the above mentioned categories.

Rule Under Article 19 (a)-Board of Trustees of National level:
In case a Trustee of the Board of Trustees leaves the Party or tenders resisignation, his/her seat in the Board of Trustees shall automatically fall vacant & President of United Democratic Party shall appoint a new Trustee to fill-up the vacaney thus caused.


DISCIPLINARY RULES
Authorities who can take disciplinary Under Article 19 (f) (iv):
Subject to the following restrictions, the Working Committee Executive of Pradesh Committee, Territories Committees &Executivies of District Committees can take action against a Party Committee who commists breach of discipline:
(a)             The Working Committee can take action against any Party Committee & any individual Party man, but not against the National Committee.
(b)             The Executive of a Pradesh Committee can take action only against Committees subordinate to it &indivisuals other than members of National Committee & members of Parliament in whose case it can only make recommendations to the Working Committee for disciplinary action.
(c)              The Executive of a District Committee can take action only against Committees subordinate to it & members of District Committee & of its Subordinate Committee can not take such action against a person who is a delegate or a member of a legislature. In such cases it can only make recommendations to the competent authority for taking disciplinary action.


2.Delegation of Authority Under Article 27 (b):
                                             The Working Committee shall be competent to delegate its authority to sub-committee under Article-27 (b) but niethor the Executive of a Pradesh Committee, Terroterist Committee nor of a District Committee shall delegates its Powers. However, the Executive of a Pradesh Committee, Terroterist Committee &a Executive of a District Committee may constitute sub-committee to examine cases for Disciplinary action coming before it & to make recommendeations to the Executive Committee concerned.


3.Power of Suspension:
(i)  The Party President can place under suspension any committee & any member of the Party, If there is a Prime facie breach of discipline. The President should place this matter before the next meeting.
(ii)   The President of Pradesh Committee can place under suspension any Committee subordinate to Pradesh Committee, any member of Pradesh Committee or Committee sub-ordinate to the Pradesh Committee, but not a member of Parliament or National Committee, If there is a Prime facie brech of discipline. All such cases for suspension & subsequent decision there on shall be reported to National Committee office within a week from a date of such suspension ordecision. But he should place the matter before the next meeting of the Executive of Pradesh Committee & proceedings should be initiated so as to dispose of disciplinary action case within one month of the suspension order.


4.Breach of Discipline:
Breach of Discipline includes the following:
(i)Deliberately action or carrying on propaganda against the Programme& decisions of the Party.
(ii)     Deliberately disregarding rules or disobeying orders pass by any competent authority.
(iii)   In dulging in fraudulent action relateing to Party funds, inrolment of members or election to Committees.
(iv)    Being guilty of ofences involving moral turpidute black marketing, adulteration, brebery, corruption, forgery, embezzlement of the Party Funds or dealing in Liquor.
(v)    Deliberately action in a way calculated to lower the prestige of the Party or carrying on propaganda against Party Committee or Office-bearers thereof.


5. Notices:
(i)No disciplinary action shall be taken without an opportunity being given, with atleast 2 weeks notice to the Committee or individual concerned, to explain its or his/her case & answer such charges as are made against it or perriod of notice when it deems fit to do so.
               (ii)Notice can be issued at the instance of the President of the Party, Competent to take disciplinary action, provided that he feels there is a Prime facie breach of discipline against the Committee or person concerned.

6.                          Punishment:
Following punishment is prescribed:
(i)In the case of a Party Committee, supersession of such a Committee & such other action against offending indivisual members as may be necessary.
                  (ii)  In the case of an Office-Bearer or member of any Party Committee, his removal from Office of membership & fixation of a period during which he can not be releted or nominated to any Office or membership in any Committee or inrolment as Primary member.
               (iii)   In the case of a member, his removal from membership & disqualification from membership for a specified period.
                                     Provided that if any person against whom disciplinary action has been taken & punishment awarded, in a member of a  any local body, Legislature, Parliament or holds any others position by virtue of his being a Partyman, he may also be called upon to resign from such bodies.


7.                        Report of Disciplinary Action:
Any disciplinary action taken either by the Executive of the District Committee or Pradesh Committee & the Working Committee respectively within a week of such action.


8.                        Appeal:
(i)It shall be open to any Party Committee or Person against whom discipilanary action is taken, to appeal to the Working Committee in the case of dicisions of Pradesh Committee Executive & to Pradesh Committee Executive in the case of decisions of District Committee Executive. Within 3 weeks of the receipt of the order provided the National Committee or the Pradesh Committee as the case may be, however, stay the Execution of the order appeled against whenever deemed fit.
(ii)  Appeals should be fited in duplicate within 3 weeks of the receipt of the order of the Committee concerned.
(iii)   Pending the desposal of the appeal against disciplinary action involving removal from an Executive Committee the vacancy thus created shall not be filled.


Article 20 Tresurer:
                  The treasurer shall be incharge of the Funds of the Party & shall keep proper accounts of all investments, income &expendinature.


Article 21 General Secretaries:
   (i)Subject to General Control of the President,the General Secretaries shall be incharge of the office of the National Committee.
   (ii)  The General Secretaries shall be responsible for the preparation & publication of a report of the proceeding of the Party Session including its audited accounts, as soon as possible after the session.
   (iii)   The General Secretaries shall prepare a report of the work of the National Committee & the Working Committee; including an audited statement of accounts for the period since the last submission of such a report & submit the same to the 1st meeting of the National Committee held before the Plenary session of the Party.


Article 22 Scruting of Membership:
The Central Election Authority shall arrange for scrutiny of membership through the Pradesh Election Authority. Appeals regarding Scrutiny of members will be disposed of by Pradesh Election Authority. Pradesh Election Authority will appoint Scrutiny Committee at appropriate levels.


Rule Under Article 22-Scrutiny of Membership:
A.Any person, who has been refused enroiment as a member under Article 5 (A) (a),(b) & 5 (B) or whose name has been omitted from or incorrectly entered in the register of Members, oramy member, who objects to the intery of any name therein, may submit to the Chairman of District Scrutiny Committee appointed by the Pradesh Election Authority concered an objection in writing strating the resons against such refusal, an omission irregular or wrong intery in 7 days of publication & the preliminary election rolls.
        B.    The District Scrutiny Committee after hearing the objector or any other Party concerned, may direct any name to be entered into corrected or omitted, from the Register of members. The Scrutiny Committee shall ordinarily dispose of such complaints within 7 days of their filling.
       C.     The District Scutiny Committee shall have the Power to scrutinize the membership from of any member & to enquire into whether the rules & provisions of the Party Contitution regarding such membership have been fulfilled. The Scrunity Committee may also
Scrutinise the periodical reports submitted by the members. They shall then take their decision after giving an opportunity for explanation to the persons concerned.
(iv)   The District Scrutiny Committee shall maintain a brief record of these proceedings & a copy of the decision shall be forwarded to the persons concerned within 3 days of such decision.
        (v)    If there is no District Party Committee functioning in the District at the time & there is an ad-hoe Committee, all objections should be submitted to the District Scrutiny Committee appointed by Pradesh Election Authority.
(vi)   Appeals against the decision of the District Scrutiny Committee shall be filed before Pradesh Election Authority by the aggrieved Party within 10 days of the decision taken by the District Scrutiny Committee. Pradesh Election Authority shall District Scrutiny Committee will be operative only when the time for appeals has expired or after the disposal of an appeal aiready filed.
    (vii)   It shall be competent for the Pradesh Election Authority & the District Scrutiny Committee to delegate the authority vested in them under these rules to one or more sub-committees or individuals.
    (viii)   The aggrieved Party may file an appeal the Central Election Authority within 10 days of the decision taken by Pradesh Election Authority.


Article 23 Election Disputes:
                 Pradesh Election Authority will take such steps as necessary to conduct the Organisational elections in a free & fair manner. Any election disputs shall also be adjudicated by Pradesh Election Authority. All appeals against the decisions of Pradesh Election Authority shall be disposed of by the Central Election Authority.


Rule Under Article 23- Election Disputes:
1.    A complaint against the election of the President Treasurer & Members of the Executive Committee of a Pradesh Party Committee & members of the National Committee shall be filed before the Central Election Authority within 15 days of the declaration of the result of such elections. The Election Authority may empanel from amongst its members, a special forum for deciding such complaints.
2.    Only a member of Pradesh Committee concered can file a petition referred to in clause (i) above.
3.    Every election petition other than those in clause (i) above shall be filed before Pradesh Election Authority within 7 days of the declaration of the result of such an election.
4.    Election petitions may be presented to Pradesh Election Authority either in person or by registered post.
5.    It shall be Competent for Pradesh Election Authority to pass any order be way of stay or injunction pending the disposal of the petition or appeal.
6.    Every election petition shall ordinarily be disposed of by Pradesh Election Authority fails to do so, the Central Election Authority may make suitable arrangements for their disposal.
7.    The Central Election Authority shall frame regulation for the conduct of bussiness by Pradesh Election Authority in connection with the disposal of election petitions & appeals.
8.    No person other than the Candidate, who files the election petition or appeal shall have the right to appear before Pradesh Election Authority except with its approval, provided that lawyers shall, in no case, be engaged.
9.    Pradesh Election Authority shall have the Power to delegate the authority vested in then under these rules to one or more of its members.
10.                       Any dispute regarding elections at the Primary unit level & at the Block level may be submitted before the District Committee. Executive within 10 days of the declaration of the results. District Committee Executive shall dispose of such cases within 10 days of its presentation.
Any appeal against the decision of District Committee Executive may be filed before the Pradesh Election Authority within 10 days of the decision taken by District Committee Executive. Any dispute regarding elections of District Committee level may be submitted before Pradesh Election Authority within 10 days of the declaration of results.
Pradesh Election Authority shall dispose of the all appeals within 10 days of the presentation of such appeals.
Any appeal about the election of Pradesh level can be filled before the Central Election Authority within 10 days of the declaration of results. The Centrl Election Authority will dispose of all such disputes within 10 days after its representation.


Pradesh Election Authority will be the final adjudicator about election disputes at Primary Unit, Block & District levels. If there is any dispute in the election at any level other than the Pradesh Committee level which requires examination from Contitutional Point of view & rules may be brought to the notice of the Central Election Authority for adjudication. Such matters will have to be brought before the CEA within 10 days after declaration of results of the concerned election.


Article 24 Election Machinery:
(i)Election Authority- The Working Committee shall set up a Central Organisation Election Authority of the National Committee comprising of not less than 3 nor more than 5 members, one of which will be Chairman of such Authority. The Chairman & the members of the Authority. The Chairman & members of the Authority be not hold any organisational office during their tenure as Chairman & member of the Authority. A part from conducting the organisational election, this Authority will also supervice& oversee enrolment of members for Organisational elections. The Authority will be also finalise the calendar of election starting from enrolment of members up to the stage of completion of the elections.
(ii)   The Chairman of the Central Election Authority will be the Ex-Offic-
Io Returning officer to conduct elections of the Office of Party President & Members of the Working Committee.
(iii)  The Central Election Authority of the Natinal Committee shall appoint aPradesh Election Authority at Pradesh Committee level comprising of not less than 3 & not more than 5 members, one of which will be the Chairman of the Authority. The term of Office of the Election Authority will be 3 years. The Chairman or members of the Authority will not hold any organisational office during their term. The Central Election Authority shall appoint Pradesh or Territorial Returning Officer.
(iv)  For smooth funcationing of the Organisational elections, the Central Election Authority will make necessary rules & regulations.
(v)  The Pradesh Returning Officer shall conduct all Party elections in the Pradesh.He shall, in constitution with the Executive of Pradesh Committee or Territorial Committee & District Committees appoint District Returning Officers & such other officers as may be necessary for the proper conduct of elections in Pradesh or Territory. He shall also perform such other functions as are allotted to him by the Central Election Authority from time to time.
(vi)   Pradesh Returning Officer shall hold office ordinarily for one term but he will continue till a new Pradesh Returning officer is appointed or he is removal from office in accordance with the rules framed in this behalf by the Central Election Authority.


Rule Under Article-24- Election Machinery:
A.    Every Pradesh Returning Officer & all other Returning Officer under him shall be Members of the Party & shall not hold any Office or Membership in any Committee. They shall not also stand us Candidates for any Party election within the area of which they function as Returning Officers during the period the hold such Office & for 6 montys thereafter.
B.    Pradesh & District Returning Officers shall locate there offices at the respective headquters of Pradesh & District Party Committee,provided that with the special permission of the Respective higher Authorite, they can locate them elsewhere.
C.    Pradesh Returning Officer shall be responsible for the conduct of all the Party elections in Pradesh. Pradesh Election Authority shall take neseccery decisions for the proper conduct of elections in accordance with the sprite of the contitutions& the rules thereunder.
D.   The Central Election Authority may also remove from office a PRO & the PEA may remove a DRO or any other Election officer if it is satisfied that he has not discharge or will not discharge his duties in a manner befitting his office, provided that before such action is taken due opportinuty shall be given to him to answer the charges brought against him.
E.     No returning Officer or any other Officer shall have the power to delegate any of his functions accept with the permission of PRO or the Officer superior to him.
F.     Candidates for Election shall not be appointed as Returning Officers or to any Election Office in their respective areas. Thus aCandidate for Election to a Block Committee shall not be appointed as Election Officer in the Block, a candidate for election to a Disdrict Party Committeeas not be appointed as an Election Officer in the District. Similarly, an Election Officer or Returning Officer of a Block shall not contest for election to Pradesh Committeefrom the same Block. He can, however, contest election to Pradesh Committee from any other Block/Contituency.
G.   Subject to the supervision or Control of Pradesh Returning Officer, District Returning Officer shall be responsible for the conduct of all Party elections in the District. He shall also appoint, with the approval of Pradesh Returning Officer, Polling & other Officers in the District.
H.   District Returning Officers shall fix location of the Polling stations& specify the area condered by each polling station and Public them at least 10 days before the polling date. He shall also notify, atleast 10 days before the Polling, the date of Poll & the Polling hours.
I.       The Polling Officers shall be responsible for keeping order at the Polling stations & to see that the election in fearly conducted.
J.      Nomination Paper in form prescribed by Pradesh Election Authority shall be filed before the concerned Returning officer by candidate or his representative in person addressed to the Returning Officer. Nomination Paper can be printed, typed or hand written.
K.    Withdrawals from the validly nominated Candidates shall be filled before the concerned Returning Officer so as to reach him at least 48 hours before the day of Voting. Withdrawal Paper should be in writing & signed by the candidate with drawing his candidature.
L.     The following shall be the procedure for elections to be held by Ballot:
(a)   The Polling officer shall be respossible for maintaining Secrecy of voting & for regulating the number of voters to be  admitted to the Polling Booths at a time.
(b)    District Returning Officer or the concerned Pollicy officer shall permit the agents of the candidates access to the Polling Booths for observing the polling officer will intial each Ballot-Paper in the space provided for the purpose before handing it over to the voter.
(c)  At the close of Polling, the Polling Officer shall count the votes secured by each candidate & report the figure to the Returning Officer. The Candidates and/or one of their agents may be present at the counting if they so desire.
(d)    On receipt of the figure relating to the number of votes secured by each candidate the Returning Officer shall declare the result.
(e)     On receipt of the figure relating to the number of votes secured by each Candidate the Returning Officer shall declare the results.
M.   The following shall be the procedure when voting is to be held by so of hands in the election at Primary unit level:-
(a)    The Polling Officers shall scrutinize every voter before he enters the meeting place.
(b) The Polling Officers shall associate in the counting one agent of each candidate. After counting the Polling Officer may obtain the signature of the Polling agents on the counting sheet.
(c)     Whenever Possible, the Polling officer may mark separate enclosures for each candidate & may ask the voters to go to the enclosures of their choice to facilitate counting of votes.
(d) The Polling Officers in the assemble of Primary Members shall announce time for proposing candidateds for election & the said Assembly. The Polling Officer shall also notify time for the Commencement & closing of voting. He shall, however, have the power to extend this time by half an hour if he finds it necessary.
N.     During election a candidate shall not use Vehicles for bringing voters nor shall he resort to any undersiablepamphleteering or other kind of Public propaganda. Contravantion of these provisions shall render the candidate’s election inualid& further make him Liable to disciplinary action.
O.     The first meeting of the members of Pradesh Committee shall be convened & Presided over by the PRO or in his absence by a nominee of the President of Pradesh Committee, all Executive Members including Office-Bearers such as vice-President, Treasure etc. who come under elected category & all other Committee which are needed to be elected by Pradesh Committee, shall be elected.
                        The first meeting of the members of District Committee shall be convened & Presided over by DRO concerned, or  in his absence, by a nominee appointed by PRO & such meeting the President of District Committee, all Executive members including Vice-President, Tresurer etc. who come under elected category, shall be elected.

Article 25-A parliament Board:
           The Working Committee shall set up a Parliament Board contisting of the Party President & nine other members, one of whom will be the leader of the Party in Parliament, with the President as the Chairman for the purpose of regulating & co-ordination the Parliamentaty activities of the Legislature Parties & shall frame rules in that behalf.


Article 25-B Election Committees:
(i)A Central Election Committee shall be set up consisting of members of the Parliament Board & 9 other members elected by National Committee for the purpose of:
(a)Making the final selection of the Canidates of the    State & Central Legislature &
(b)Conducting election campaigns
       (ii)  Pradesh Election Committee shall consist of the President of the PT/TC, the Leader of the Party Legislature &/or in case of a Union Territory, the Leader of Party in the Assembly/Metropolitan Council & not more than 10 & less than 4 others members, who shall be elected by the General Meeting of Pradesh Committeeor the Territory Committee. If the members of the Committee are elected by 2/3 majority present & voting, they shall be decleared elected. The voting for such a election shall be by Ballot & each Ballot-Paper the voter should have to recorded as many votes as 3 are members to be elected to the Committee. In case a 2/3 majority is not secured by each of the members to be elected, there shall be a fresh election by the system of single transferable vote. The President of the Pradesh Committee or Territor Committee shall be Ex-Officio Chairman Pradesh or Territorial Election Committee.
(iii)   The Pradesh or Territorial Election Committee, constitution in the above manner, shall recommend candidates for the Central & State Legislatures to the Centrl Election Committee.
(iv)   The Central Election Committee shall frame necessary rules ti give guidance to the Pradesh Election Committee in regard to the selection of Candidates & other matters relating to the conduct of elections.


Rule Under Article 25 –Formation of Parliamentary Board & Election Committees:
1.      Formation of Parliamentary Board:
     The Paliamentary Board shall be set up by the Working Committee from amongst the members of the Working Committee at its 1st meeting after its formation & shall continue in office till a new Board is set up.
2. Formation of Election Committees:
A.     The Chairman Of the Central Election Authority shall be the Returning Officer for conducting the Election of members of the Central Election Committee.
B.      The Central Election Committee shall be set up by the National Committee from amongst its members ordinarily at the 1st meeting after its formation & shall continue in office till a new CEC is set up. It shall function for the General Election or any Mid-term Election that might be held.
C.     Pradesh Election Committee shall be set up from amonst the members of the Pradesh Committee ordinarily at the 1st meeting after its formation & shall continue in the office till a new Committee is elected. The RPO shall be the Returning Officer of this election.
D.     In case Pradesh Election Committee is not elected as provided in the Constitution, the Central Election Authority shall take necessary steps to conduct the election of Pradesh Election Committee.
3.Procedure for Election of 9 Members of the Central Election Committee:
         A.    Nominations should be proposed & seconded by the members of the National Committee with full voting rights.
        B.    A member of the National Committee with full voting rights can propose as many as 9 names for the membership of the Central Election Committee from amongst the members of the National Committee with full rights.
        C.   A Nomination Paper should signify the consent of the candidate proposed.
        D.   Voting shall be any Ballot.
        E.   The Voting shall be by proportional representation according to the system of single transferable vote.


Article 26 Vacancies:
1.    The office of a delegates or a member of any Committee or Board Constituted under this Constitution shall be vacated by resignation, removal or death.
2.     All vacancies shall, unless otherwise provided for, be filled in the same menner in which the vacated member was chosen & member so elected shall hold office for the unexpired term of the seat vacated.
3.     In the absence of any provision to the contrary a Committee or Board, once it is properly constituted, shall not become invalid by reason of any vacancy on it.


Article 24-A Cells & Departments:
1.     The President may create cells/Departments to discharge responsibilities as assigned to such Cells/Departments.
2.    The Chairman/ Members of such cells/ Departments shall be appointed by the Party President.
3.      Chairman of such cells/ Departments may appoint Chairman & Members of cells/ Departments at Pradesh level in consultation with Pradesh Committee.

Article 23 Miscellaneous:
(i)No person shall be a member of any 2 parallel Committee.
(ii) A Committee may delegate any of its power to a smaller Committee or an individual.
(iii)  Where there is a qution of the value of fraction a fraction of ½ & more shall be treated as 1 & less than ½  as 0.
(iv)   Wherever in this constitution, the word, “ vote” or any of its inflections occurs, itmeans or refers to a valid vote.
(v)  The Block, District & Pradesh Committee shall elect from amongst its members, the President, Vice-Presidents & Treasures & members of their Executive Committee & from amongst the members of the Executive Committee& from amongst the members of the Executive Committees. The Presidents of the respective Committees shall appoint Secretaries.
(vi)  Population figures of the last available census shall be the basis for all Party purpose.
(vii)  Any question or dispute arising under the constitution with regard to provisions, contests, interpretation or the procedures laid down therein, between members & Committees or between Committees enterse, shall be determined by this constitution & the binding on all members & Committees of the Party & shall not be liable to question by any them in a court of law.
(viii)  Any member, who does not attend 3 Successive meeting of any Party Committee without prior intiamation of his absence shall cease to be a member of the Committee concerned.
Article 28 Changes in the Constitution:
The Constitution can be amended, altered or added to only by a session of the Party. The National Party shall, however, have authority, except in regard to Article 1, to amend, alter or add to the constitution when the Party is not in session if so desired by the Working Committee provided that no such addition, alteration or amendment shall be made by the National Committee except by a majority of 2/3 of the members present & voting at a meeting held specially for this purpose after due notice of the proposed changes have been given to each member, atleast 1 month prior to the date of such a meeting. The changes made by the National Committee shall be placed before the next session of the Party for ratification but they may come into operation even before ratification from such date as may be Prescribed by the Natinal Committee.

Article 29-Party Flag:
The flag of United Democracy Party shall consist of three horizontal colours: Saffron, White & Green with the Hand Draw picture of a looking like RISING SUN.


 MISCELLANEOUS (RULES)
A.    Disqualification of candidates for elections:
(a)             Election Officers:
             Pradesh Returning Officers & other Election Officers shall not be eligible to stand as Candidates for any Party election in the area where they funcation during the time they are in office & for a period of 6 months there after.
(b)              Defaulters of Subscription or other dues:
(I)                The Leaders of the Legislature Parties (in the states & at the centre should fix a time. Limit within which the members should pay up their contribution every month.
(II)             A member of the Legaslature, who fails to pay his contribution within the time fixed by the Executive of the Legislature Party shall be debarred from standing for Party or organigational elections from standing for Party or Organisational elections.
(III)           The Secretary of the Legislature Party should convey to the Secretary of Pradesh Committee and the Secretary of District Committee from time to time information about the members who have failed to pay their dues within the time-limit.
(IV)          The Secretaries of Pradesh Committee & District Committee on receipt of such information should inform the PRO & DROs that such members of the Legislature are ineligible for organisationalelections.
(V)            Such members will not be eligible for information by Pradesh Committee or District Committees or the subordinate Party Committee to any Committee or or& Subcommittee.
(VI)          In the event of a member of the Legislature paying his arrears, the Secretary of the Party intimate to the Secretary of Pradesh Committee & District Committee that the arrears are paid & a similar intimation will be given by the Secretary of the Pradesh Committee & District Committee to the PRO & the DROs. On receipt of such information the PRO & the DROs will declare then as eligible provided such information is received by the PRO or DRO concerned atleast 24 hours before the time for nomination.
(VII)       Parliament, who are not members of a Legislature & against whom there are any arrears pending will also be not eligible for organisational elections or to be nominated to any Committee or Sub-Committee.
2.Method of Voting:
                     Where the Constitution or Rules do not specify the method of election to any office or Committee, Voting shall be by Ballot & to be elected, it shall be by simple majority.

3.Formationof Party Committee:
                                    A Party Committee will be deemed to have been duly Constituted provided that atleast ¾ of its members have been dully elected out of the total number of valid members including the reserue quota to be elected. However, in the case of Block Party Committee, 50% of its Members from the Primary Units will have to be elected for being duly constituted.
4.    Term of Co-Opted member:
                        The term of the co-opted members shall be co-terminus with that of the elected members of the Committee concered.
5.    Option to Choose Membership of a Committee:
(i)When a member of Pradesh Committee & District Committee is elected from an area in which, he does not reside, he should indicate the Pradesh Committee or District Committee concerned, in writing the name of District Committee or Block Committee of which he desires to be a member beforeb there 1st meeting, failing which he will be deemed to have opted for District Committee or Block Committee in the area from which he has been elected.
(ii)  When a member of Parliament or state Legialature is elected from an area coming under more than 1 sub-ordinate Party Committee or District Committee, as the case may be he shall  beintitled to become an Ex-Officio member of the sub-ordinate Party Committee & the District Committee concerned under whose juridication he normally resides.
6.     General:
(i)The President of any Party Committee shall have the authority to remove any of its Office-Bearers appointed or nominated by him provided he is satisfied that he is not discharging his duties to  his satisfaction. However, due apportunityshall be given to the Office-Bearer concered to explain his position before such an action is taken against him.
(ii)  The President of a Party Committee shall have the authority to appoint an Acting President for a short period from amongst the Vice-Presidents with the previous permission of the Superior Party Committee concerned in case he is not able to function as such for a limited period.
7.    Formation of Ad-hoc Committee at the District & Block Level:
On the failure of a District or Sub-Ordinare Committee or any other lower Committee there of to be constituted or in function in terms of the Constitution or in accordance with the directions of the superior committee to carry on Party work in area but no District Committee shall be superseded, suspended or an adhoc Committee constituted by Pradesh Committee without the prior approval of the Working Committee & similarly no District Commitionshall supersede or from an Ad-Hoc subordinate Committee without the prior approval of Pradesh Committee concerned. An Ad-hoc Committee so constituted shall ordinarily function for a period can be extended by 3 months at a time upto a total period of 1 year with the approval of the immediate superior Committee. Unless other wise specified, an Ad-hoc Committee shall enjoy the same powers & privileges of a normal Committee.
                                        However, the Working Committee shall have the right to extend the period of an Ad-hoc Committee beyond 1 year under special circumstrances.
8.    Functioning of Frontal Organisations:
(i)Each Frontal organsiation should have its own Contitution. It should have its own membership apart from their membership
Of the Party. Regular election should be held at every level. A system also needs to be developed for co0ordination between the Frontal organisations& the parents development for close co-ordination between the frontal organizations & the parent body at every level. More intensive & extensive consltations should be held between the parent body & the Frontal Organisations, especially on policy matter.
(ii)  Autonomy of the Frontal Organisation should be ensured in regard to the election/selection of functionaries. They should have autonomy in Working out their own programmes.
(iii)  Each Frontal Oranisation shall have an Advisary Committee headed by the Party President. The Advisory Committee shall be  appointed by the Party President. The Advisory Committee shall be appointed by the Party President in constitution with aespective Frontal Organisation.
9.    Authority to Frame Additional rules:
        In the case of any difficulty in implementing any of the provisions made-in the constitution, the Party President shall have authority to issue instructions & to frane necessary rules to overcome the difficulty.
